Privacy Policy

This policy explains what personal data www.medialem.com collects, why it collects it, who it is passed to, how long it is kept, and the rights you have over it.

1. Data controller

2. What we collect

2.1 Contact forms

When you fill in a form on this site, we collect what you enter into it:

  • your name;
  • your email address;
  • your phone number;
  • where applicable, the service or services you are interested in, or the type of platform you have in mind;
  • the message you write.

Those fields are the only ones the form sends. Please do not include sensitive information in them.

2.2 Booking a demo

The demo request page offers a booking calendar provided by HubSpot. It is only loaded if you click to open it: until you do, no data is exchanged with HubSpot from that page. If you book a slot, the information you enter into the calendar is collected directly by HubSpot on our behalf.

2.3 Analytics and advertising

If, and only if, you agree through the banner shown on your first visit, the site loads analytics and advertising tools that set cookies and collect browsing data: pages viewed, time spent, where you came from, device and browser type, IP address. If you decline, none of these tools is loaded.

2.4 Technical data

Like any web server, the one hosting this site automatically records the requests it receives: IP address, date and time, page requested, response code and browser. These logs are used to operate the site, keep it secure and diagnose incidents.

The site offers no account registration, no comments and no newsletter.

3. Purposes and legal bases

  • Answering your enquiry and, where relevant, preparing a contract — legal basis: steps taken at your request prior to entering into a contract (GDPR Article 6(1)(b)).
  • Following up on your enquiry commercially — legal basis: our legitimate interest in managing relationships with prospects and clients (Article 6(1)(f)).
  • Measuring site traffic and serving advertising — legal basis: your consent (Article 6(1)(a)), which you may withdraw at any time.
  • Keeping the site secure and diagnosing incidents — legal basis: our legitimate interest in running a reliable service (Article 6(1)(f)).

4. Recipients and processors

We do not sell your data and do not pass it to third parties for their own marketing. It is accessible to the Zak Ben Consulting team and to the following providers, who act on our instructions:

  • Brevo (Sendinblue SAS, France) — delivery of the emails generated by the forms.
  • HubSpot (HubSpot, Inc., United States) — customer relationship management: your enquiries are recorded there, along with demo bookings and, if you have consented, the associated analytics.
  • Google (Google Ireland Limited) — analytics and advertising, only after consent.
  • Meta (Meta Platforms Ireland Limited) — advertising, only after consent.
  • Hotjar (Hotjar Ltd., Malta) — analysis of how the site is used, only after consent.
  • Contabo GmbH (Germany) — website hosting.

5. Transfers outside the European Union

Some of these providers, HubSpot in particular, are established in the United States or may process data there. Such transfers rely on the mechanisms provided for by the GDPR: the adequacy decision covering the EU–US Data Privacy Framework where the provider is certified under it, and the European Commission’s standard contractual clauses otherwise.

6. How long we keep it

  • Enquiries sent through the forms: three years from our last exchange, then deleted or anonymised.
  • Contractual and accounting records, where a commercial relationship begins: for as long as the law requires, generally ten years.
  • Analytics and advertising cookies: thirteen months at most, in line with the CNIL’s recommendation.
  • Your recorded answer about cookies: six months, after which you are asked again.
  • Server logs: twelve months at most.

7. Cookies and trackers

Two cookies are strictly necessary for the site to work and do not require your consent:

  • pll_language — remembers the language you are reading the site in.
  • medialem_consent — stores your answer to the cookie banner so you are not asked again on every page. Duration: six months.

Every other tracker is loaded by a tag manager, and only once you have accepted. They set cookies whose names begin with _ga, _gid, _gcl (Google), _fbp, _fbc (Meta), _hj (Hotjar), __hs and hubspotutk (HubSpot), among others.

You can change your mind at any time using the “Cookies” link at the bottom of the page. If you decline after having accepted, the cookies those tools set on our domain are deleted. Cookies set on a third party’s own domain cannot be removed from our site: your browser settings let you do that.

8. Your rights

Under the GDPR and the French Data Protection Act, you have the right to access, rectify, erase, restrict and port your data, to object to its processing, and to withdraw your consent at any time where processing relies on it.

To exercise these rights, write to zakaria@medialem.com. We reply within one month. We may ask you to prove your identity if there is reasonable doubt about who is making the request.

If our answer does not satisfy you, you may lodge a complaint with the French data protection authority (CNIL), 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, or at www.cnil.fr.

9. Security

The site is served over HTTPS only. Access to the administration area and to data submitted through the forms is limited to the people who need it. No system is infallible, so we cannot guarantee absolute security, but we apply technical and organisational measures appropriate to the risks involved.

10. Changes to this policy

This policy may change to reflect changes to the site or to the law. The date it was last updated appears at the top of this page. If trackers change substantially, the consent banner will be shown to you again.
